Terms of Sale

1. Purpose and scope

These Terms of Sale govern consumer purchases concluded on dansoatelier.com between Ibrahim Danso, whose details appear in the Legal Notice, and any individual purchasing outside a professional activity. The version accepted at checkout is the version applicable to the order.

2. Products and made-to-measure service

The seller makes and sells made-to-measure clothing, including shirts, suits, dresses and similar pieces. The service includes a personal measurement profile, cloth and finish selection, and manufacture to the customer’s specifications. Photographs are illustrative; slight differences in cloth colour, texture or appearance caused by natural variation or screen rendering do not by themselves constitute non-conformity. If an approved cloth becomes unavailable, the seller will offer an equivalent or a full refund.

3. Prices

Prices are displayed in euros inclusive of applicable taxes, with delivery costs identified before final confirmation. VAT is not applicable under Article 293 B of the French General Tax Code. Premium cloth, unusual finishing, monograms or other additions require a prior quote accepted by the customer.

4. Order process

1. Select the garment, cloth and finishes.
2. Provide or validate measurements.
3. Review the price, production estimate and delivery terms.
4. Accept these Terms and the made-to-measure withdrawal exclusion using unticked checkboxes.
5. Select “Order with obligation to pay” and complete secure Stripe Checkout.
6. Receive the payment confirmation and order reference.

The customer can correct all form fields before payment. When measurements are supplied remotely, the customer is responsible for their accuracy. The seller may refuse an abnormal or fraudulent order or an order connected with an unresolved earlier dispute.

5. Payment

Payment is made by card through Stripe. The seller does not store card data. The order enters production only after effective payment and final approval of cloth and measurements. Failed or refused authorisation does not create a paid order. Stripe may issue a hosted invoice in addition to the seller’s numbered invoice.

6. Production and binding delivery information

Estimated production: 4 to 6 weeks after final approval of measurements and fabric. It starts after final approval of both measurements and cloth. The delivery date or period stated in the order confirmation is binding. If the seller fails to deliver on that date, the customer may follow the remedies provided by Articles L.216-1 and following of the French Consumer Code, including requiring performance within a reasonable additional period and, where the statutory conditions are met, terminating the contract and receiving the refund due.

7. Delivery

Tracked delivery in metropolitan France within 2 to 5 business days after dispatch; quoted separately for EU and international orders. The parcel is delivered to the address approved by the customer. A dispatch email identifies the carrier, tracking number and tracking link. Risk of loss or damage transfers only when the customer, or a nominated third party other than the carrier, physically takes possession of the parcel. The customer should report visible damage promptly without losing any statutory right.

8. No withdrawal right for personalised goods

Under Article L.221-28 3° of the French Consumer Code, the 14-day right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised. A garment produced from the customer’s measurements and choices of cloth and finishes is therefore excluded. The customer expressly acknowledges this before payment. This exclusion does not limit the legal conformity guarantee or the guarantee against hidden defects.

9. Alterations

One alteration session requested within 14 days after delivery is included when adjustment is needed because of a cutting, making or measurement-transcription error attributable to the seller. Alterations caused by incorrect customer-supplied measurements, a later change in body shape or a change of mind about the cut may be quoted separately.

10. Legal guarantees

The seller remains liable for lack of conformity under Articles L.217-3 and following of the French Consumer Code and for hidden defects under Articles 1641 and following of the French Civil Code. The legal guarantee of conformity applies for two years from delivery. Normal wear, damage caused by care contrary to the label, third-party alterations or abnormal use are not defects attributable to the seller. These statutory rights apply independently of any commercial guarantee.

11. Care

The customer must follow the care label. Wool, silk, linen and other fine materials may require specialist cleaning. Damage caused by unsuitable cleaning is not covered as seller non-conformity.

12. Complaints and mediation

Send complaints to contact@dansoatelier.com or Ibrahim Danso, 4 rue Pierre Ginier, 75018 Paris, France. The seller aims to reply within 10 business days. If the written complaint remains unresolved, the customer may contact the consumer mediator named in the Legal Notice free of charge. The mediator’s appointment must be completed before live launch.

13. Personal data

Personal information, including body measurements, is processed as described in the Privacy Policy and only as needed to perform the order, comply with law and administer after-sales service.

14. Force majeure

Neither party is liable for failure caused by force majeure within Article 1218 of the French Civil Code, without prejudice to mandatory consumer remedies.

15. Applicable law and disputes

French law applies. The parties will first seek an amicable solution. If that fails, the customer retains all rights to bring proceedings before a court having jurisdiction under mandatory consumer law, including the option provided by Article R.631-3 of the French Consumer Code.
